ObjectLinks is a web application optimized for mobile devices that allows management of multiple information and advertising content associated to real objects or web content. The service ObjectLinks helps anyone who wanted to associate this content to real objects directly to the web or optimizing it for mobile devices including but not limited to, smartphones and tablets.

You acknowledge and agree that the use of this service is subject to terms and conditions posted on the website www.okkam.it in section ObjectLinks terms of use, and on the website http://ol.objectlinks.biz/. You acknowledge that these terms may change from time to time by OKKAM Srl. OKKAM SRL  will inform immediately the user as is described in the section: change the terms of use.

By using this service, you accept the terms of use of the platform ObjectLinks.
These Terms of use constitute a legally binding agreement between OKKAM Ltd and you with respect to use of the Service. It 's important to take time to read them carefully.

If you don’t accept these terms of use with the following conditions, you can not use ObjectLinks.

Definition of the service

With the term ObjectLinks (OL) there are considering all links generated through the use of web-based platform ObjectLinks. OKKAM Srl reserves all rights. The links generated are property of OKKAM Srl. These kind of links can be encoded into any technological system that allows the encoding, for example but not limited to, QR codes, RFID sensor or NFC sensors.

How to use ObjectLinks

  1. The platform ObjectLinks (http://my.objectlinks.biz/) developed by OKKAM Srl allows individuals and organizations to create and manage dynamic QR-code linked to OL, which you can host one or more links to sites or applications, and add / remove / edit link at any time after the creation of the OL.
  2. The dynamic page that appears when the scan resolution and an OL is divided into three distinct sections:
    • a first section "Owner's links" (in the upper portion of the page), where appears links reported by your OL;
    • a second section "Partner Links" (divided from the previous one by a horizontal line) is the section where links are presented by third parties.
    • a third section, "Social apps" (in the bottom of the page), contains some buttons where to share the contents of the page through some social network platforms, such as Facebook or Twitter;
  3. The base use of the services is provided for free and unlimited by ObjectLinks. It is developed by OKKAM Ltd. Therefore, the creation of an OL, develops it and their management will not involve any payment. Customizations and the development of ad-hoc services have to be considered different.
  4. The use of ObjectLinks is free and it is subject on two general conditions:
    • the maintenance of the words "Powered by OKKAM" on the bottom of the QR-code printed, unless specific agreements from time to time between OKKAM Ltd and the owner of the QR-code;
    • the acknowledgement of the rules concern the use of "Partner Links"visible when you resolved the OL.

Intellectual Property

  1. All materials (including the organization and presentation of the same) shown on these website:www.okkam.it and http://ol.objectlinks.biz is owned by OKKAM Srl and its licensors. The material is subjected to protection under the laws of intellectual property, including laws relating to copyrights, trademarks, registered names, internet domain names and other similar rights. Except the case where the user has a specific agreement with OKKAM Ltd, such as a royalty-free license agreement, OKKAM Ltd prohibits any other use of this material without the written consent of OKKAM Ltd. The material may be copied and used only for personal purposes, non-commercial, personal or educational, it being understood that should not be changed and are not deleted all copyright and other proprietary information. The user has the right to create derivative works or in any way exploit the material. © 2010 OKKAM Srl all rights reserved.
  2. Each OL generated with the platform ObjectLinks is owned by OKKAM Srl. Except the case where the user has entered into a specific agreement with OKKAM Srl, such as a royalty-free license agreement, it is forbidden any use of this material without the written consent of OKKAM Srl. This allows OKKAM SRL to publish advertising content in Partner Links section associated with each OL generated and handled by the platform. © 2010 OKKAM Srl All rights reserved.
  3. The QR code generated that contain inside OL must be marked at the bottom of the QR code with the words “powered by OKKAM”. If this brand identity has been removed without the written consent of OKKAM Srl the terms of use of this service are violated. In this case OKKAM Srl reserves to intervene in the judical offices to protect the rights of the ownership of the trademark.
  4. OKKAM Srl maintains the control and the exclusive use of the Partners links section except of the options available in terms of sales and rentals for do advertising with ObjectLinks.
  5. Layout, illustration or visual representation generated optically, electronically, digitally or by any other tools or in any other media or other material loaded from the Website can not be changed except the content that could be customizations. Once the QR code "powered by OKKAM" is downloaded from the ObjectLinks platform, the QRcode is ready for reproduction and print. After the creation of the OL you accepts all the terms of use. OKKAM Srl is not responsible where the QR code will be applied and how it will be used.
  6. The user, as content administrator will be the only owner of the QR code generated but not the owner of the OL stored inside the QR code.
  7. Nothing contained in this Agreement grants the user the right to use the name of OKKAM, ObjectLinks or any of its trademarks, logos, domain names and other distinctive brand.

Basic conditions

These Terms of Service ("Terms") regulate access and the use of services by the user, including websites, email notifications, applications, all information, text, graphics, photographs or other material loaded or downloaded or present on the Services (collectively, "Contents").

  1. The Terms are applied to all users of the service, including those who, tra l’altro, entering Content on the Service. The terms “Contents” include textual contents, software, script, graphic elements, pictures, sound content, music, videos, audiovisual combinations, interactive features and other materials displayed, or accessible through, or plug-in, the Service by the user.
  2. The user is the only administrator of the OL, he will be the only one responsible about the use of Services, the Content posted on the Services and for any consequences originate from these actions. The Content submitted, posted or made visible by the user will be visible to other users, through third party services and web sites(websites, social networking, QR codes). The user must provide only contents that it considers might share with others in accordance with these Conditions.
  3. The user may use the Services on ObjectLinks only if he has the ability to accept an agreement with OKKAM Srl and he is not a person that can't use the Services according the Italian law or form another jurisdiction applicable. In case of acceptance of these Terms and use of the Services on behalf of a company, organization, public administration or other legal entity, the user represents and warrants that he is authorized to do it. The user may use the Services only in accordance with these Terms and all applicable laws, rules, regulations local, state, national and international legislation.
  4. If at any time OKKAM Ltd chooses, in exclusive rights, to monitor a Promotion, OKKAM Ltd doesn't assumes liability for its contents. OKKAM Ltd has not the obligation to modify or remove any inappropriate content or promotion, and is not responsible for the conduct of third party entry or who manage a promotion.
  5. OKKAM Ltd does not actively monitor the use of services or promotions Sponsor facts on its platform. In the same way OKKAM Ltd does not exercise any editorial control or review over the content or nature of any promotion or any, website, e-mail transmission, newsgroups, or other material created or accessible over or through promotions. However OKKAM Ltd reserves the right to remove any content as described in the protection of third party rights.
  6. OKKAM Ltd intends to cooperate fully with low officials responsible in the investigation of any violation of these Terms of Use or other terms, conditions, policies, or guidelines on the website www.okkam.it as well as all applicable laws, rules or regulations. By using this service, OKKAM Srl is released from any and all liability arising from such cooperation with agencies, local control, state forces (Postal Police, the Guardia di Finanza, etc..) and other relevant to the country where the Service is applied.
  7. We reserve to keep the platform ObjectLinks active, without errors and safe, but the user is agree to use it at his own risk. ObjectLinks is provided as is, without any implied warranty, including, for example, the implied warranties of merchantability, appropriateness for a particular non infringements purpose. We can not guarantee that ObjectLinks will always be safety or free of error or operate without interruption, delay or defect. OKKAM Ltd is not responsible for the actions, content, information or data to third parties, therefore we, our directors, officers, employees and agents are relieved of any claim or damage, whether known or unknown, arising from the use of the Service, and we are in any way connected with complaints directed against such parties.
  8. OKKAM Ltd in response to the violation of these Terms of Use or any other terms, conditions, criteria or guidelines posted on the site www.okkam.it or associated with ObjectLinks it reserves the right to:
    1. release warnings: written or verbal;
    2. suspend or interrupt a promotion and/or the use of the service, as soon as possible;
    3. take legal action to enjoin violations and / or to collect damages, if caused by violations.
  9. OKKAM Ltd is committed to maintaining the privacy of personal data of individuals which interacts. It was been a privacy commitment on site www.okkam.it, containing a description of the policies and practices relating to privacy and the way in which they are collected, used and disclosed personal information from visitors to the site http://ol.objectlinks.biz/.
  10. You may not use the Service ObjectLinks for any of the following commercial use, without the written permission by OKKAM Ltd:
    1. the sale of access to the Service;
    2. the sale of advertising, sponsorships or promotions without agreeing to the terms of the Service and conditions of the use of advertising on OL;
    3. the sale of advertising, sponsorships or promotions in the multilinks used exclusively for the inclusion of information content. For the sale of advertising, see the section (Rules for advertisers) and the terms of use agreement.
  11. ObjectLinks is in continuous innovation to provide the best possible experience for its users. The user acknowledge and agree that the form and nature of the Service provided by OKKAM Ltd may change from time to time without prior notice.
    1. As part of this continuing innovation, the user agree that OKKAM Ltd may stop (either temporarily or permanently, the Service or any features within the Service) to users in general at the only discretion of OKKAM Srl without being notified in advance. It could be possible to stop using the service at any time. The user will not be informed in details when OKKAM Ltd stops using the service.
  12. The user agrees that OKKAM Ltd may provides to the user notices, including those regarding changes to the Terms, by email, or postings on the websites:www.okkam.it and http://ol.objectlinks.biz/.

Liability

The user takes all responsibility and all risks arising by the use of ObjectLinks and its material, including without limitation all informationstored in it. Under no circumstances OKKAM Ltd, its directors, officers, employees, shareholders, partners or agents be liable for damages of incidental, indirect, punitive, exemplary, consequential or any other type (including loss of use, profit, or commercial information, or any other pecuniary loss), arising from protest, losses, damages, actions, suits or other proceedings whether or not arising under these terms of use, including without limitation or related in any way to the use of the site, the material or any part of there or for any rights granted to you under the Agreement, even if OKKAM Ltd is advised about the possibility of such damages, whether the action is based on contract, offense (including negligence), infringement of intellectual property or other. In any case, the global maximum liability under these terms of use, the use or exploitation of any kind of all or part of the site or materials, will be limited to 5 euro (€ 5.00). Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In this case, the above limitation may not apply.

Website linked by ObjectLinks

ObjectLinks allows the user to link third party website within one or more OL. The inclusion of such links does not imply that OKKAM Ltd controls, or support / endorse the websites to which they are related. OKKAM Ltd does not accept any liability for such websites.  OKKAM Ltd shall have no liability either directly or indirectly for any damage or loss of any kind caused or knowingly caused by or regarding the use or appoint of any information, content, goods or services available on or through any third party site or resource linked in OL.

Sharing content, information, and linked websites

  1. The user is the owner of all contents and information published on ObjectLinks.
  2. Comments or suggestions by users referred to ObjectLinks are always welcome. However, the user must be aware that we may use them without any revenue obligation (in the same way that the user is not obliged to supply it).

Safety

OKKAM Ltd undertakes that ObjectLinks is a secure site, but OKKAM Ltd can not guarantee itd. We need that users contribute to protect the safety of ObjectLinks in this case that they committed in:

  1. Do not post unauthorized commercial communications (such as spam) on ObjectLinks
  2. Do not collect users' content or information, or otherwise access to ObjectLinks using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior consent.
  3. Do Not undertake multi-level marketing opposite to these Terms of use, such as pyramid schemes, on ObjectLinks.
  4. Do not upload viruses or other malicious code.
  5. Do not try to get login information or access to other users' accounts.
  6. Do not post contents: threat, pornographic, pedo-pornographic, with incitement to hatred or violence, with nudity or strong or free violence.
  7. Not develop or use third-party applications with content related to alcohol, services for meetings or otherwise aimed at an adult audience (including advertisements) without appropriate age restrictions.
  8. Follow the guidelines proposed by OKKAM Ltd on how to advertise through ObjectLinks.
  9. Do not use ObjectLinks for illegal purposes, misleading, malicious, or discriminatory.
  10. Do not take any action that would prevent, overburden, or damage the right functioning or appearance of ObjectLinks, such as a denial of service or other disruptive actions that interfere with the rendering of the pages or with other ObjectLinks functions.
  11. The user will not facilitate or encourage any violations of this Statement or our policies.
  12. The user shall immediately notify at OKKAM Ltd any breach of security or unauthorized use of his account that he becomes aware of ObjectLinks.
  13. OKKAM Ltd maintain the right to access, read, preserve and publish all the information that OKKAM Ltdbelieves essential for:
    • comply with any applicable law, regulation, legal process or governmental request;
    • enforce compliance with the conditions, even by the investigation of potential violations about its;
    • detect, prevent, or otherwise deal with fraud or security issues or technical;
    • respond to requests for assistance from users;
    • protect the rights, ownership or safety of ObjectLinks, its users and for the people.
  14. During accessing or using the Services the user shall not do any of the following:
    • access, tamper with or use restricted areas of the Services, computer systems ObjectLinks technical delivery providers from ObjectLinks;
    • probe, scan or test the vulnerability of any system or network or infringe or circumvent any security or authentication measure;
      • access or search the Services by any means (automated or otherwise) other than the published interfaces currently available, provided by ObjectLinks, unless you have been specifically authorized by a special agreement with OKKAM Ltd (NOTE: carrying out research for the purpose of indexing (crawling) in respect of the Services is permitted if it is in compliance with the regulation of the robots.txt file, however, the extraction of information carried by automated (scraping) without the prior consent of OKKAM Ltd is expressly prohibited);
    • falsify the header of any TCP/IP packet header or any part of the information of any e-mail or post or otherwise use the Services to send information identifying the source altered, deceptive or false;
    • overwrite the OL generated by other users through the platform ObjectLinks attempt to or through any electronic means or otherwise, to modify the contents included in the platform.
    • interfere with or distrupt (or attempt to do so) access of any user, host or network, also, including example but not limited to, introducing computer viruses, overloading the system or using techniques of flooding, spamming or mail-bombing to the detriment of the Services or acting through script on the creation of Content in such a manner as to interfere with the Services or cause an overload.

Registration and account safety

Users of ObjectLinks provide their name and their real information and OKKAM Ltd invites everyone to do the same. About the registration and to maintain the security of your account, you agree to:

  1. Do not provide false personal information on OKKAM Ltd or create an account on behalf of another person without authorization.
  2. Do not create another account without the permission of OKKAM Ltd if the original account is disabled.
  3. To be ensure that your contact information is always accurate and up to date.
    1. Do not share your password, or don't allow others to access your account or take any other action that could lay it on the line the security of your account.
  4. Do not transfer your account to a third party (including any page or application managed) without the prior written consent of OKKAM Ltd.
  5. Each holder of an ObjectLinks account can insert contents from third parties. The user understands that, regardless of the fact that its contents are published or not on ObjectLinks, ObjectLinks don't guarantee any confidentiality with respect to Content.
  6. The user is responsible for the conservation of the password that he uses to access the Services and for any activities or actions that require the use of this password. OKKAM Ltd recommends the use of complex password (formed by a combination of uppercase and lowercase letters, numbers and symbols) for their own account ObjectLinks. OKKAM Ltd can not accept, or does it assume any responsibility for any loss or damage caused by disregard of these recommendations.

Protection rights of third parties

OKKAM respects the rights of others and expects you to do the same.

  1. You will not post or perform actions through the platform ObjectLinks that constitute infringement of third party rights or applicable laws in any way. OKKAM Ltd reserves the right to remove any content or information that users post on ObjectLinks, in cases where it is deemed that violates this Statement or corporate regulations.
  2. If the user deletes the contents because they were considered to infringe the copyright of third parties, and the user who posted them believed that there was a mistake, the user has the opportunity to make a complaint by writing an email to: info@okkam.it OKKAM Ltd and asksexplanations and demonstrating its good fait.
  3. If the user repeatedly violates the intellectual property rights of third parties, where deemed appropriate, OKKAM Ltd proceeds to disable the account.
  4. The user will not use copyright or trademark OKKAM Ltd, ObjectLinks which may be the subject of confusion, unless expressly permitted by our Guidelines on the use of trademarks or after obtaining our written consent.
  5. If the uers collects information from other users, undertakes to: getting their permission, specify to be him / her (and not OKKAM Ltd) to collect information, and publish its Privacy Policy to explain what information you collect and how are using it.
  6. It is forbidden to publish identity documents or sensitive financial information on ObjectLinks.

Phones and other devices

Mobile services that OKKAM Ltd provides the platform through ObjectLinks for now are free, but will still be charged at the normal rates of telephone operators, such as the cost of text messages or data connection.

Payments

In the case where the user emits payments ObjectLinks, must accept the terms of payment of OKKAM Ltd.

Using PARTNERLINKS

  1. OKKAM Ltd reserves the right to use the PartnerLinks section to transmit information to third parties, including various forms of commercial communication on OL generated through the free platform ObjectLinks except the choice of a different pattern of use of the platform.
    • option “Protected”. OKKAM Ltd gives to the owner of the QR-code the right to use to your liking the "PartnerLinks" in exchange of an annual fee for use of the space in question. Rates are specified on service costs page can be found at: www.okkam.it/objectlinks/costi_del_servizio. With this option, the section “Partner Links” can be used freely by the owner, who may wish to host link / third-party applications through trade agreements and not.
    • option “Open”. The owner of the QR-code decides to leave at OKKAM Ltd the right to use the section “Partner Links”. OKKAM Ltd has the right to charge in "Partner Links" section, for free or by payment, any number of links to third-party. This scenario of commercial exploitation of the section “Partner Links”is explained in detail in section: www.okkam.it/objectlinks/costi_del_servizio.
    • option“No Profit”. OKKAM Ltd permits locking of the part Partner Links disabling any kind of commercial exploitation of the platform. This option can only be selected if the user belongs to associations NON-PROFIT and demonstrates through an authentic certificate sent to info@okkam.it the purposes of non-profit association that owns expressly stating NOT to use the OL generated for commercial purposes or financial gain.

Rules for advertisers

Advertisers can apply to specific recipients by purchasing advertising on ObjectLinks or on our network for publishers. The following additional terms shall apply in the event that an order is made through our online advertising portal (Order):

  1. At the time of the Order, the advertiser must indicate the type of advertising you want to buy, the amount you want to spend and your offer. If OKKAM Ltd accepts the Order, the advertisement will be published as soon as the list will be available. At the time of publication of an advertisement, OKKAM Ltd will be active for up to show the advertisement by associating it with any type of OL specified by the advertiser, although you can not guarantee that your advertisement reaches always the OL and consequently the desired objects.
  2. Orders must be paid in accordance with the Payment Terms OKKAM Ltd. The amount to be paid will be calculated based on the detection mechanisms implemented by the company.
  3. The ads must comply with our Advertising Guidelines.
  4. OKKAM Ltd determines the size, the position of the insertions.
  5. OKKAM Ltd makes no warranties or activity or the number of clicks that are generated from advertising.
  6. OKKAM Ltd is not able to control the number of clicks generated by insertions. ObjectLinks have systems that can detect and filter certain click's activities, but is not responsible about fraud, technical issues or others activity that are not non-related to valid clicks that may affect the cost of advertising.
  7. Orders may be canceled at any time via the online portal, but the stop of active listings may take up to 24 ore. The user is required to pay all current listings.
  8. The proposed license from OKKAM Ltd for the execution of listings end after completing the Order. However, if users have interacted with the advertising, it will remain active until it is deleted by users.
  9. OKKAM Ltd reserve the right to use the ads and related information for marketing or promotional.
  10. OKKAM Ltd reserves the right to reject or remove any ad for any reason.
  11. If the user inserts ads on behalf of someone else must have permission to do so. In particular, the user must:
    • ensure that you have the legal authority to bind the advertiser to this Statement;
    • agree that if the advertiser represented violates this Declaration, the same user may be held responsible for such violation.

Change the terms of use

OKKAM may periodically make changes the Terms, for example consequently the changes to legislation or regulatory requirements or functions offered through the Service. Therefore, it is strictly suggested to check periodically these Terms. The new version of the Terms ("Terms Modified") will be published at www.okkam.it / terms_of_use or made available within the Service (for each additional change) and sent by e-mail to subscribers. In case of rejection of the modified Terms, you must stop using the Service. In the event that you continue to use the Service following the posting of the modified Terms, that use will established implicit acknowledgement of the modified Terms.

Dispute

  1. Any claim, dispute or substantive law between the user and OKKAM Srl arising from this Statement or the use of ObjectLinks will be resolved in the competent court. The Declaration, as well as any dispute that may arise between the two parties,are governed by the laws of the Italian State, without regard to conflict of law provisions. The user agrees to submit to the personal jurisdiction of the court of justice, in Italy, in the event of a dispute concerning such disputes.
  2. In case arise complaints against OKKAM Ltd relating to the actions, contents or user information on ObjectLinks, the user will be bound to reimburse OKKAM LTd and to ensure OKKAM LTd from and against any damage, loss or expense (including reasonable legal costs and expenses) arising from such complaint. Even if OKKAM Ltd provides rules for conduct users, OKKAM Ltd does not control or guide the actions of users on ObjectLinks and is not responsible for the content or information that users transmit or share on ObjectLinks.
    • OKKAM Ltd is not responsible for any information or content offensive, inappropriate, obscene, unlawful or otherwise illegal present on the OL generated through the service ObjectLinks.
    • OKKAM Ltd is not responsible about the conduct, online or offline, of any user on ObjectLinks.

Disclaimer and warranty

  1. Nothing reported in this Terms should affect any statutory rights, to which the user has the right as a consumer and can not be modified or waived by agreement.
  2. The Service is provided "as is" and OKKAM Ltd makes no warranties or representations with respect to it.
  3. In particular OKKAM Ltd does not represent or warrant that:
    • the use of the Service meet the user needs;
    • the use of the Service will be uninterrupted, timely, safety or without error, any information obtained by the user as a result of his use of the Service is accurate or reliable, and defects the operation or functionality of any software provided to you as part of the Service will be repaired.
  4. No conditions, warranties or other terms (including any implied terms as to satisfactory quality, appropriateness for purpose or conformance with description) it could be apply to the Service except as expressly provided in these Terms.

Definizione del servizio

Con il termine ObjectLinks (OL) si considerano tutti i links generati attraverso l’uso della piattaforma web ObjectLinks di cui OKKAM Srl detiene ogni diritto.  I links generati rimangono di proprietà di OKKAM Srl e possono essere codificati e inseriti all’interno di ogni sistema tecnologico che ne permette la codifica come possono essere, a titolo esemplificativo ma non esaustivo, QR codes, sensori RFID o sensori NFC.

Modalità d’suo di ObjectLinks

  1. La piattaforma ObjectLinks (http://my.objectlinks.biz/) sviluppata da OKKAM Srl permette a individui e organizzazioni di creare e gestire QR-code dinamici che puntano a OL, all'interno dei quali è possibile ospitare uno o più link a siti o applicazioni e aggiungere/togliere/modificare link in qualunque momento successivo.
  2. La pagina dinamica visualizzata al momento della scansione e risoluzione di un OL è suddivisa in tre sezioni ben distinte:
    • una prima sezione “Owner's links” (nella porzione superiore della pagina), dove sono presentati i links segnalati dall’amministratore di OL;
    • una seconda sezione “Partner Links”(separata da quella precedente da una linea orizzontale etichettata “Partner Links”), dove sono presentati link di parti terze rispetto all’amministratore dell’OL;
    • una terza sezione “Social apps” (al fondo della pagina), che contiene alcuni bottoni per condividere il contenuto della pagina con alcune piattaforme di social networking, come possono essere a tiolo esemplificativo ma non esaustivo Facebook o Twitter;
  3. L'utilizzo dei servizi di base della piattaforma ObjectLinks è fornito dalla OKKAM Srl a titolo gratuito e in forma illimitata. Pertanto, la creazione di OL e la loro gestione non comportano alcun contributo in denaro. Sono da considerarsi a parte invece eventuali personalizzazioni della stessa o lo sviluppo di servizi ad-hoc per il suo utilizzo o la connessione con sistemi informativi del proprietario.
  4. L'utilizzo gratuito è subordinato a due condizioni di natura generale:
    • il mantenimento della scritta “Powered by OKKAM” nella parte inferiore della stampa del QR-code, salvo accordi specifici presi di volta in volta tra OKKAM Srl e il proprietario del QR-code;
    • l'accettazione delle regole di utilizzo della sezione “Partner Links” visibile una volta risolto l'OL.

Proprietà intellettuale

  1. Tutto il materiale (incluse l'organizzazione e la presentazione degli stessi) presente sul sito: www.okkam.it e http://ol.objectlinks.biz è di proprietà di OKKAM Srl e dei suoi licenzianti. Il materiale è passibile di tutela ai sensi delle leggi in materia di proprietà intellettuale, incluse le leggi relative a copyright, marchi di fabbrica, denominazioni registrate, nomi di domini internet ed altri diritti analoghi. Fatto salvo il caso in cui l'utente abbia stipulato un accordo specifico con OKKAM Srl, quale un Contratto di licenza libera da diritti, è vietato qualsiasi altro uso di detto materiale senza il consenso scritto di OKKAM Srl. Il materiale può essere usato e copiato dall'utente soltanto per scopi propri, non commerciali, personali o formativi, restando inteso che non deve subire modifiche e che non siano cancellati il copyright e le altre informazioni di proprietà intellettuale. L'utente non ha la facoltà di creare opere derivate o di sfruttare il materiale in alcun modo. © 2010 OKKAM Srl Tutti i diritti riservati.
  2. Ogni OL generato con la piattaforma ObjectLinks è di proprietà di OKKAM Srl. Fatto salvo il caso in cui l'utente abbia stipulato un accordo specifico con OKKAM Srl, quale un Contratto di licenza libera da diritti, è vietato qualsiasi altro uso di detto materiale senza il consenso scritto di OKKAM Srl. Questo consente OKKAM SRL di pubblicare contenuti pubblicitari nella sezione Partner Links dell’interfaccia associata a ogni OL generato e gestito attraverso tale piattaforma. © 2010 OKKAM Srl Tutti i diritti riservati.
  3. I QR code generati che all’interno contengono un OL devono riportare la dicitura in pedice al codice bidimensionale “powered by OKKAM”. Qualora questo marchio d’identità fosse rimosso senza il consenso scritto di OKKAM Srl si violano i termini d’uso del servizio. In questo caso OKKAM Srl si riserverà di intervenire nelle sedi giudiziarie competenti a tutela dei diritti di proprietà del marchio.
  4. OKKAM Srl mantiene il controllo e l'uso esclusivo della sezione Partner links fatta eccezione per le diverse possibilità presenti nei termini di vendita e affitto per la pubblicità su ObjectLinks.
  5. Layout, illustrazione o rappresentazione visiva generata con mezzi ottici, elettronici, digitali o con qualsiasi altro mezzo o in qualsiasi media o altro materiale caricato dal Sito, nonché il materiale che accompagna il precedente, non sono modificabili ad eccezione delle integrazioni da parte dell'utente che personalizza i Contenuti. Una volta che l'utente scarica il QR code “powered by OKKAM”, pronto per la riproduzione in stampa, accetta tutte le Condizioni di OKKAM Srl. OKKAM Srl non si ritiene responsabile di dove verrà applicato e come verrà utilizzato il QR code dopo la stampa.
  6. L’utente, come amministratore di contenuti, sarà l’unico proprietario del QR code generato ma non il proprietario dell’OL presente all’interno del QR code.
  7. Nulla di quanto contenuto nelle presenti Condizioni concede all’utente il diritto di utilizzare il nome di OKKAM, ObjectLinks o qualsiasi suo marchio, logo, nome a dominio e altro elemento distintivo del marchio.

Condizioni base

Le presenti Condizioni del Servizio (“Condizioni”) regolano l'accesso e l'utilizzo dei servizi da parte dell'utente, ivi inclusi i vari siti web, notifiche email, applicazioni, ogni informazione, testo, grafica, fotografia o altro materiale caricato o scaricato o presente nei Servizi (congiuntamente definiti “Contenuti”).

  1. I Termini si applicano a tutti gli utenti del Servizio, compresi gli utenti che, tra l’altro, inseriscono Contenuti sul Servizio. Il termine “Contenuti” comprende contenuti testuali, software, script, elementi grafici, foto, contenuti sonori, musicali, video, combinazioni audiovisive, funzionalità interattive e altro materiale visualizzabile, o accessibile mediante il, o inseribile nel, Servizio da parte dell’utente.
  2. L’utente, unico amministratore dell’ OL, sarà l’unico responsabile del proprio utilizzo dei Servizi, dei Contenuti postati sui Servizi e di ogni conseguenza derivante da tali azioni. I Contenuti inviati, postati o resi visibili dall'utente saranno visualizzabili da altri utenti e tramite servizi e siti web di terzi (siti internet, social network, QR-codes). L’utente dovrà fornire esclusivamente contenuti che ritiene di poter condividere con altri nel rispetto delle presenti Condizioni.
  3. L’utente potrà usufruire dei Servizi presenti sulla piattaforma ObjectLinks esclusivamente qualora abbia la possibilità di accettare un contratto vincolante con OKKAM Srl e non sia un soggetto interdetto all'uso dei Servizi secondo la legge italiana o di un'altra giurisdizione applicabile. In caso di accettazione delle presenti Condizioni e di utilizzo dei Servizi per conto di una società, organizzazione, pubblica amministrazione o altro ente avente personalità giuridica, l'utente dichiara e garantisce di essere autorizzato ad agire in tal senso. L'utente potrà utilizzare i Servizi esclusivamente in conformità alle presenti Condizioni e a ogni legge, norma, regolamento locale, statale, nazionale e internazionale applicabile.
  4. Se in qualsiasi momento OKKAM Srl sceglie, a sua esclusiva discrezione, di monitorare una Promozione, OKKAM Srl non si assume alcuna responsabilità per il suo contenuto. OKKAM Srl non ha l'obbligo di modificare o rimuovere i contenuti inappropriati o di promozione, e non è responsabile per la condotta di terzi in entrata o di chi conduce una promozione
  5. OKKAM Srl non monitora attivamente l'uso dei servizi o promozioni Sponsor fatti sulla sua piattaforma. Allo stesso modo OKKAM Srl non esercita alcun controllo editoriale o recensione sul contenuto o la natura di qualsiasi promozione o di qualsiasi, sito web, trasmissione e-mail, newsgroup, o altro materiale creato o accessibile da o attraverso le promozioni. Tuttavia OKKAM Srl si riserva la possibilità di rimuovere ogni contenuto come descritto nella sezione protezione diritti di terzi.
  6. OKKAM Srl intende cooperare pienamente con i funzionari preposti all'applicazione della legge nelle indagini di qualsiasi violazione delle presenti Condizioni d'uso o altri termini, condizioni, criteri o linee guida presenti sul sito www.okkam.it nonché di tutte le leggi, regole o regolamenti. Utilizzando questo Servizio, si rilascia OKKAM Srl da ogni e qualsiasi responsabilità derivante da tale cooperazione con le agenzie di controllo locali, le forze statali (Polizia postale, Guardia di Finanza ecc.) e pertinenti al paese di applicazione.
  7. Ci impegniamo a mantenere la piattaforma ObjectLinks attiva, esente da errori e sicura, ma l’utente accetta di utilizzarla a suo rischio e pericolo. ObjectLinks viene fornito così com’è, senza alcuna garanzia implicita, tra cui, a titolo esemplificativo, le garanzie implicite di commerciabilità, idoneità a uno scopo specifico o non violazione. Non possiamo garantire che ObjectLinks sarà sempre sicuro o privo di errori o che funzionerà sempre senza interruzioni, ritardi o imperfezioni. OKKAM Srl non è responsabile delle azioni, dei contenuti, delle informazioni o dei dati di terze parti, pertanto noi, i nostri direttori, incaricati, dipendenti e agenti siamo sollevati da qualsiasi reclamo o danno, noto o sconosciuto, derivante dal suo utilizzo, e non siamo in alcun modo collegati con eventuali lamentele indirizzate contro le suddette parti.
  8. OKKAM Srl in risposta alla violazione delle presenti Condizioni di Utilizzo o qualsiasi altro termine, condizioni, criteri o linee guida, pubblicate sul sito www.okkam.it o associate con il Servizio di ObjectLinks si riserva di:
    1. emettere notifiche: scritta o verbale;
    2. sospendere o interrompere una promozione e/o l'utilizzo del servizio, per quanto possibile;
    3. agire in giudizio per far cessare le violazioni e/o per la raccolta danni, eventualmente causati da violazioni.
  9. OKKAM Srl s'impegna a rispettare la privacy dei dati personali delle persone con le quali interagisce. E’ stato predisposto un impegno in materia di privacy sul sito www.okkam.it, recante la descrizione delle politiche e prassi in materia di privacy e del modo in cui vengono raccolte, utilizzate e comunicate le informazioni personali di chi visita il sito http://ol.objectlinks.biz/.
  10. Non è consentito usare il Servizio ObjectLinks per alcuno dei seguenti usi commerciali, senza la previa autorizzazione scritta di OKKAM Srl:
    1. la vendita dell'accesso al Servizio;
    2. la vendita di pubblicità, sponsorizzazioni o promozioni posizionati su, o all'interno del, Servizio, o Contenuti senza aver accettato le condizioni contrattuali relative all'uso della pubblicità su OL;
    3. la vendita di pubblicità, sponsorizzazioni o promozioni nella sezione multilinks adibita esclusivamente per l'inserimento di contenuti informativi. Per la vendita di pubblicità si veda la sezione (Regole per gli inserzionisti) e i termini d'uso del contratto.
  11. ObjectLinks è oggetto d'innovazione continua in modo da fornire la miglior esperienza possibile ai suoi utenti. L’utente riconosce e accetta che la forma e la natura del Servizio che OKKAM Srl fornisce potrà cambiare di volta in volta senza una comunicazione preventiva;
    1. come parte di questa continua innovazione l’utente accetta che OKKAM Srl possa interrompere (in maniera temporanea o permanente la fornitura del Servizio o di qualsiasi elemento all’interno del Servizio) nei suoi confronti o nei confronti degli utenti in generale a esclusiva discrezione di OKKAM Srl senza che ciò sia preventivamente comunicato. E’ possibile smettere di usare il servizio in qualsiasi momento. L’utente non dovrà informare in via specifica OKKAM Srl in caso smetta di utilizzare il servizio.
  12. L’utente accetta che OKKAM Srl potrà fornire all'utente comunicazioni, comprese quelle riguardanti le modifiche dei Termini, tramite e-mail, o comunicazioni pubblicate sui siti internet: www.okkam.it e http://ol.objectlinks.biz/.

Assunzione di responsabilità

L'utente si assume ogni responsabilità e tutti i rischi derivanti dall’uso di ObjectLinks e del materiale, incluse senza limitazione tutte le informazioni contenute. In nessun caso OKKAM Srl, i relativi direttori, funzionari, dipendenti, azionisti, partner o agenti potranno essere ritenuti responsabili per il risarcimento di danni di natura incidentale, indiretta, punitiva, esemplare, consequenziale o di qualsiasi altro tipo (inclusa la perdita di utilizzo, profitto o informazioni commerciali, o qualsiasi altra perdita pecuniaria), derivanti da reclami, perdita, danni, azioni, cause o altri procedimenti siano essi o meno originati dalle presenti condizioni d'uso, inclusi senza alcuna limitazione o correlati in qualsiasi modo all'uso del sito, del materiale o di parte di essi ovvero da qualsiasi diritto garantito all'utente secondo il detto accordo, anche se siamo stati avvisati della possibilità di tali danni, sia che l'azione si basi su contratto, illecito (inclusa la negligenza), violazione dei diritti di proprietà intellettuale o altro. In ogni caso la responsabilità massima globale ai sensi di queste condizioni d’uso, dell’uso o dello sfruttamento di qualunque tipo della totalità o di parte del sito o del materiale, sarà limitata a cinque euro (€ 5.00). Alcune giurisdizioni non consentono di limitare o escludere la responsabilità per danni incidentali o consequenziali. In tal caso la suddetta limitazione non si applica.

Siti internet collegati attraverso la piattaforma ObjectLinks

La piattaforma ObjectLinks permette all’utente di collegare siti di terzi all’interno di uno o più OL. L'inclusione di detti collegamenti non implica che OKKAM Srl controlla o appoggia/approva i siti internet ai quali si riferiscono. OKKAM Srl non accetta alcuna responsabilità per tali siti internet.  OKKAM Srl non avrà responsabilità dirette né indirette per danni o perdite di qualunque genere causati o consapevolmente causati da o riguardo all’uso o all'assegnamento su qualsiasi informazione, contenuto, bene o servizio disponibile su o tramite qualsiasi sito di terzi o risorsa collegata.

Condivisione dei contenuti, informazioni e siti internet collegati

  1. L'utente è il proprietario di tutti i contenuti e le informazioni pubblicate su ObjectLinks.
  2. I commenti o i suggerimenti degli utenti che si riferiscono a ObjectLinks sono sempre benvenuti. Tuttavia, l'utente deve essere consapevole del fatto che potremmo usarli senza alcun obbligo di compenso nei suoi confronti (allo stesso modo in cui l'utente non è obbligato a fornirli).

Sicurezza

Ci impegniamo al massimo per fare in modo che ObjectLinks sia un sito sicuro, ma non possiamo garantirlo. Abbiamo bisogno che gli utenti contribuiscano a tutelare la sicurezza di ObjectLinks ovvero che se impegnino a:

  1. non pubblicare comunicazioni commerciali non autorizzate (ad esempio spam) su ObjectLinks;
  2. non raccogliere contenuti o informazioni degli utenti, né accedere in altro modo a ObjectLinks usando strumenti automatizzati (come bot di raccolta, robot, spider o scraper) senza previa autorizzazione da parte nostra;
  3. non intraprendere azioni di marketing multi-livello contrari ai presenti termini d’uso, ad esempio schemi piramidali, su ObjectLinks.
  4. non caricare virus o altri codici dannosi;
  5. non cercare di ottenere informazioni di accesso o accedere ad account di altri utenti;
  6. non pubblicare contenuti: minatori, pornografici, pedo-pornografici, con incitazioni all'odio o alla violenza, con immagini di nudo o di violenza forte o gratuita;
  7. non sviluppare o utilizzare applicazioni di terzi con contenuti correlati all'alcol, a servizi d’incontri o comunque rivolti a un pubblico adulto (comprese le pubblicità) senza le dovute restrizioni di età;
  8. seguire le linee guida proposte da OKKAM Srl su come fare pubblicità attraverso ObjectLinks;
  9. non usare ObjectLinks per scopi illegali, ingannevoli, malevoli o discriminatori;
  10. non intraprendere azioni che possano impedire, sovraccaricare o compromettere il corretto funzionamento o l'aspetto di ObjectLinks, ad esempio con un attacco di negazione del servizio o altre azioni di disturbo che interferiscano con il rendering delle pagine o con altre funzioni di ObjectLinks;
  11. non favorire o incoraggiare alcuna violazione della presente Dichiarazione o delle nostre normative;
  12. l'utente dovrà comunicare immediatamente a OKKAM Srl qualsiasi violazione della sicurezza o uso non autorizzato del proprio account di ObjectLinks di cui venisse a conoscenza;
  13. OKKAM Srl si riserva il diritto di accedere, leggere, conservare e divulgare le informazioni che ritenga ragionevolmente necessarie per:
    • conformarsi a ogni legge, regolamento, procedimento legale o richiesta governativa applicabile;
    • imporre l’osservanza delle Condizioni, anche mediante l’accertamento di potenziali violazioni delle stesse;
    • individuare, impedire o in altro modo affrontare frodi o problematiche inerenti la sicurezza o di natura tecnica;
    • rispondere alle richieste di assistenza da parte degli utenti;
    • proteggere i diritti, la proprietà o la sicurezza di ObjectLinks, dei propri utenti e del pubblico;
  14. nell’accesso o nell’utilizzo dei Servizi l'utente non potrà eseguire alcuna delle seguenti operazioni:
    • accedere, manomettere o utilizzare aree riservate dei Servizi, i sistemi informatici di ObjectLinks o sistemi tecnici di recapito dei provider di ObjectLinks;
    • sondare, scansionare o testare la vulnerabilità di qualunque sistema o rete o violare o eludere qualsiasi misura di sicurezza o di autenticazione;
    • accedere o effettuare ricerche o tentare di accedere o effettuare ricerche nei Servizi mediante qualsiasi mezzo (automatizzato o meno) diverso dalle interfacce pubblicate, attualmente disponibili, fornite da ObjectLinks, a meno che l’utente sia stato specificamente autorizzato da un apposito accordo con OKKAM Srl (NOTA: l’effettuazione di ricerche a scopo di indicizzazione (crawling) nei confronti dei Servizi è permesso se ciò avviene nel rispetto delle disposizioni del file robots.txt, tuttavia l’estrazione di informazioni effettuata con modalità automatizzate (scraping) senza il previo consenso di OKKAM Srl è espressamente vietato);
    • falsificare gli header di qualsiasi pacchetto TCP/IP o parte delle informazioni nell'intestazione di qualsiasi e-mail o post o comunque utilizzare i Servizi per inviare informazioni identificative della fonte alterate, ingannevoli o false;
    • sovrascrivere gli OL di altri utenti generati attraverso la piattaforma ObjectLinks o tentare, attraverso qualunque mezzo informatico e non, di modificare i contenuti inseriti all'interno della piattaforma.
    • interferire con o interrompere (o tentare di agire in tal senso) l'accesso di qualsiasi utente, host o rete, anche, a titolo esemplificativo ma non esaustivo, introducendo virus informatici, sovraccaricando il sistema o utilizzando tecniche di flooding, spamming o mail-bombing ai danni dei Servizi o intervenendo attraverso script sulla creazione di Contenuti in modo tale da interferire con i Servizi o causarne un sovraccarico.

Registrazione e sicurezza dell'account

Gli utenti di ObjectLinks forniscono il proprio nome e le proprie informazioni reali e OKKAM Srl invita tutti a fare lo stesso. Per quanto riguarda la registrazione e al fine di garantire la sicurezza del proprio account, l'utente si impegna a:

  1. Non fornire informazioni personali false su OKKAM Srl o creare un account per conto di un'altra persona senza autorizzazione.
  2. Non creare un altro account senza il permesso di OKKAM Srl se l'account originale è disabilitato.
  3. Assicurarsi che le proprie informazioni di contatto siano sempre corrette e aggiornate.
  4. Non condividere la propria password, né consentire ad altri di accedere al proprio account o di eseguire qualsiasi altra azione che potrebbe mettere a rischio la sicurezza del proprio account.
  5. Non trasferire a terzi il proprio account (compresa qualsiasi Pagina o applicazione amministrata) senza il previo consenso scritto di OKKAM Srl.
  6. Ogni titolare di un account ObjectLinks potrà inserire Contenuti provenienti da terzi. L'utente comprende che, a prescindere dal fatto che i suoi Contenuti siano pubblicati o meno su ObjectLinks non garantisce alcuna riservatezza con riferimento ai Contenuti.
  7. L’utente è responsabile della custodia della password che utilizza per accedere ai Servizi e di ogni attività o azione che richieda l’utilizzo di tale password. OKKAM Srl consiglia l’utilizzo di password “complesse” (formate da una combinazione di lettere maiuscole e minuscole, numeri e simboli) per il proprio account di ObjectLinks. OKKAM Srl non può assumersi, né si assumerà, alcuna responsabilità per perdite o danni derivanti dall’inosservanza di tali raccomandazioni.

Protezione diritti di terzi

OKKAM rispetta i diritti di terzi e si aspetta che l'utente faccia lo stesso.

  1. È vietato pubblicare o eseguire azioni attraverso la piattaforma ObjectLinks che costituiscano violazione dei diritti di terzi o delle leggi vigenti in alcun modo. OKKAM Srl si riserva il diritto di rimuovere tutti i contenuti o le informazioni che gli utenti pubblicano su ObjectLinks, nei casi in cui si ritenga che violino la presente Dichiarazione o le normative aziendali.
  2. Se vengono eliminati dei contenuti perché considerati in violazione del copyright di terzi, e l'utente che li ha pubblicati ritiene che ci sia stato un errore, ha la possibilità di fare reclamo scrivendo un’email all’indirizzo: info@okkam.it OKKAM Srl chiedendo spiegazioni e dimostrando la sua buona fede.
  3. Se l'utente viola ripetutamente i diritti di proprietà intellettuale di terzi, nei casi ritenuti opportuni, OKKAM Srl procederà a disabilitare l’account.
  4. L'utente non utilizzerà copyright o marchi di OKKAM Srl, ObjectLinks che possono essere oggetto di confusione, salvo qualora espressamente consentito dalle nostre Linee guida sull'uso dei marchi o dopo aver ottenuto il nostro consenso scritto.
  5. Se l'utente raccoglie informazioni da altri utenti, s’impegna a: ottenere la loro autorizzazione, specificare di essere lui/lei (e non OKKAM Srl) a raccogliere le informazioni, e pubblicare una sua Normativa sulla privacy che spieghi quali informazioni raccoglie e come le utilizza.
  6. È vietato pubblicare documenti d’identità o informazioni finanziarie sensibili su ObjectLinks.

Cellulari e altri dispositivi

I servizi mobili che OKKAM Srl fornisce attraverso la piattaforma ObjectLinks per ora sono gratuiti, ma saranno comunque applicate le normali tariffe dei gestori di telefonia, ad esempio il costo dei messaggi di testo o della connessione dati.

Pagamenti

Nel caso in cui l'utente emetta pagamenti su ObjectLinks, deve accettare i Termini di pagamento di OKKAM Srl

Utilizzo della sezione PartnerLinks

  1. OKKAM Srl si riserva il diritto di utilizzare la sezione Partner Links per veicolare informazione di terze parti, incluse varie forme di comunicazione commerciale su tutti gli OL generati gratuitamente attraverso la piattaforma ObjectLinks salvo la scelta di un modello d’uso differente della piattaforma:
    • opzione “Protected”. OKKAM Srl cede al proprietario del QR-code il diritto di utilizzare a proprio piacimento la sezione “Partner Links” in cambio di un canone d'uso annuale dello spazio in questione. Le tariffe sono specificate alla pagina costi del servizio reperibile all’indirizzo www.okkam.it/objectlinks/costi_del_servizio. Con questa opzione la sezione “Partner Links” può essere utilizzata liberamente dal proprietario, che può decidere di ospitare link/applicazioni di terze parti attraverso accordi commerciali e non;
    • opzione “Open”. Il proprietario del QR-code decide di lasciare a OKKAM Srl il diritto di utilizzare la sezione “Partner Links”. OKKAM Srl ha quindi il diritto di inserire nella sezione “Partner Links”, in forma gratuita o a pagamento, qualunque numero di link di terze parti. Questo scenario di sfruttamento commerciale della sezione “Partner Links” viene spiegata dettagliatamente nella sezione: www.okkam.it/objectlinks/costi_del_servizio;
    • opzione “No Profit”. OKKAM Srl consente il blocco della parte Partner Links disabilitando ogni tipo di sfruttamento commerciale della piattaforma. Questa opzione può essere scelta solo se l’utente appartiene ad associazioni NO-PROFIT e dimostra attraverso un certificato autentico inviato a info@okkam.it gli scopi no profit dell’associazione a cui appartiene dichiarando espressamente di NON utilizzare gli OL generati per scopi commerciali o di lucro.

Regole per gli inserzionisti

Gli inserzionisti possono rivolgersi a destinatari specifici acquistando pubblicità su ObjectLinks o sulla nostra rete per editori. I seguenti termini aggiuntivi si applicano nel caso in cui venga effettuato un ordine tramite il nostro portale di pubblicità online (Ordine):

  1. Al momento dell'Ordine, l'inserzionista dovrà indicare il tipo di pubblicità che desidera acquistare, la somma che desidera spendere e la sua offerta. Se OKKAM Srl accetta l'Ordine, le inserzioni verranno pubblicate non appena l'elenco sarà disponibile. Al momento della pubblicazione di un'inserzione, OKKAM Srl s'impegnerà al massimo per mostrare l'inserzione associandola ad ogni tipologia di OL specificato dall'inserzionista, nonostante non sia possibile garantire che l'inserzione raggiunga sempre gli OL e di conseguenza gli oggetti desiderati.
  2. Gli Ordini devono essere pagati in base ai Termini di pagamento di OKKAM Srl. La cifra da pagare verrà calcolata in base ai meccanismi di rilevamento implementati dall’azienda.
  3. Le inserzioni devono rispettare le nostre Linee guida sulle pubblicità.
  4. OKKAM Srl determina le dimensioni, la posizione delle inserzioni.
  5. OKKAM Srl non fornisce alcuna garanzia né sull'attività né sul numero di clic che saranno generati dalle inserzioni.
  6. OKKAM Srl non è in grado di controllare il numero di click generati dalle inserzioni.  ObjectLinks dispone di sistemi che possono rilevare e filtrare determinate attività di click, ma non è responsabile di frodi, problemi tecnici o altre attività non valide legate ai click che possano incidere sul costo delle inserzioni.
  7. Gli Ordini possono essere annullati in qualsiasi momento tramite il portale online, ma l'arresto delle inserzioni in corso può richiedere fino a 24 ore. L'utente è tenuto a pagare tutte le inserzioni in corso.
  8. La licenza proposta da OKKAM Srl per l'esecuzione delle inserzioni terminerà una volta completato l'Ordine. Tuttavia, se gli utenti hanno interagito con l'inserzione, questa resterà attiva finché non sarà eliminata dagli utenti.
  9. OKKAM Srl si riserva il diritto di utilizzare le inserzioni e le informazioni correlate a fini di marketing o promozionali.
  10. OKKAM Srl si riserva il diritto di rifiutare o rimuovere qualsiasi inserzione per qualsiasi ragione.
  11. Se l'utente inserisce inserzioni a nome di qualcun altro, deve disporre dell'autorizzazione a farlo. In particolare, l'utente deve:
    • garantire di disporre dell'autorità legale per vincolare l'inserzionista alla presente Dichiarazione;
    • accettare che, se l'inserzionista rappresentato viola la presente Dichiarazione, l'utente stesso potrebbe essere considerato responsabile di tale violazione.

Modifiche dei termini d’uso

OKKAM Srl potrà compiere periodicamente modifiche ai Termini, per esempio conseguentemente a modifiche a livello legislativo o normativo o delle funzioni offerte attraverso il Servizio. Di conseguenza, è consigliabile controllare periodicamente i Termini per verificare eventuali modifiche. La versione modificata dei Termini ("Termini Modificati") sarà pubblicata all'indirizzo www.okkam.it/terms_of_use  o resa disponibile all'interno del Servizio (per ogni modifica aggiuntiva) e inviata per e-mail agli utenti iscritti alla piattaforma. In caso di mancata accettazione dei Termini Modificati, è necessario interrompere l'uso del Servizio. Nel caso in cui si continui a usare il Servizio in seguito alla pubblicazione dei Termini Modificati, tale uso costituirà accettazione implicita dei Termini Modificati.

Dispute

  1. Qualsiasi reclamo, diritto sostanziale o disputa tra l'utente e OKKAM Srl derivante dalla presente Dichiarazione o dall'utilizzo di ObjectLinks verrà risolta in un tribunale competente. La presente Dichiarazione, nonché qualsiasi disputa che possa insorgere tra le due parti, sono regolate dalle leggi dello stato Italiano, indipendentemente da conflitti nelle disposizioni di legge. L'utente accetta di sottostare alla giurisdizione personale della corte di giustizia, in Italia, nel caso di controversie relative a tali dispute.
  2. Nel caso in cui dovessero sorgere dei reclami nei confronti di OKKAM Srl relativi alle azioni, ai contenuti o alle informazioni dell'utente su ObjectLinks, l'utente sarà tenuto a risarcire OKKAM Srl e ad assicurare OKKAM Srl da e contro qualsiasi danno, perdita o spesa (incluse spese e costi legali ragionevoli) derivante da tale reclamo. Anche se OKKAM Srl fornisce delle regole per la condotta degli utenti, OKKAM Srl non controlla né guida le azioni degli utenti su ObjectLinks e non è responsabile dei contenuti o delle informazioni che gli utenti trasmettono o condividono su ObjectLinks.
    • OKKAM Srl non è responsabile di alcuna informazione o contenuto offensivo, inappropriato, osceno, illegale o altrimenti deplorevole presente sugli OL generati attraverso il servizio ObjectLinks.
    • OKKAM Srl non è responsabile della condotta, sia online che offline, di alcun utente su ObjectLinks.

Esclusione e garanzia

  1. Nulla di quanto previsto dai Termini potrà inficiare alcun diritto previsto dalla legge, a cui l’utente abbia diritto in qualità di consumatore e che non possa essere modificato o rinunciato convenzionalmente.
  2. Il Servizio è fornito "così come è" e OKKAM Srl non rilascia alcuna garanzia o dichiarazione con riferimento ad esso.
  3. In particolare OKKAM Srl non dichiara o garantisce che:
    • l'uso del Servizio soddisfi le esigenze dell'utente;
    • l'uso del Servizio sia ininterrotto, tempestivo, sicuro o privo di errori, qualsiasi informazione ottenuta dall'utente come risultato del proprio uso del Servizio sia preciso o affidabile, e i difetti nell'operatività o funzionalità di qualsiasi software fornito all'utente come parte del Servizio sarà riparato.
  4. Nessuna condizione, garanzia o altro termine (compreso qualsiasi termine implicito di qualità soddisfacente, idoneità a uno scopo o conformità con la descrizione) si applica al Servizio salvo che ciò sia espressamente stabilito nei Termini.
